Traffic accidents

Traffic accident reconstruction expert witness

How it really happened, told with physics rather than versions.

I have driven articulated lorries for many kilometres: I know how long forty tonnes take to stop, how a load shifts under heavy braking and what cannot be seen from a cab. That is not learned on a course.

Reconstructing an accident means answering three questions with numbers: how fast they were going, when each driver could have perceived the hazard and what would have happened had they done something else. The rest is opinion.

Cases I take

  • Rear-end, head-on and side collisions and run-off-road accidents.
  • Speeds, braking distances and reaction times, with the calculation in plain sight.
  • Disagreement with the police report or with the other side's expert.
  • Accidents involving trucks: blind spots, turning manoeuvres and load shift.
  • Pedestrians, cyclists and motorcyclists struck, with visibility at the moment it happened.
  • Shared fault: who did what, when and how far it contributed.

What I need from you

  • The full police report, with sketch plan, photographs and statements.
  • Photographs and video: security cameras, dashcam or phone.
  • Event data recorder (EDR) data from the vehicle, where available.
  • Tachograph downloads: they hold second-by-second speed before the impact.
  • Damage reports, repair estimates and photographs of the vehicles.
  • Road conditions, signage, weather and medical reports.

What the law says

  • Royal Legislative Decree 6/2015: Spanish Traffic and Road Safety Act.
  • Royal Decree 1428/2003: General Traffic Regulations.
  • Royal Legislative Decree 8/2004: civil liability and insurance in motor vehicle circulation.
  • Arts. 142 and 152 of the Criminal Code: death and injury by negligence.
  • Art. 1902 of the Civil Code: non-contractual liability.

What you get

Report produced with the Perito Tacho Method (MPT™): ten phases common to all twelve specialities, with the defensibility index and the stress test.

  • The accident sequence in phases: perception, reaction, manoeuvre and impact.
  • Speeds calculated by more than one method, with the margin stated.
  • Positions and trajectories, with scale drawings.
  • Avoidability analysis: what it would have taken for it not to happen.
  • A point-by-point comparison with the police report and the opposing expert.
  • Ratification and defence of the report in the courtroom.
ASPEJURE diploma of Pedro Mulero Sánchez — Court Expert in Traffic Accident Investigation and Reconstruction, 300 hours, distinction Traffic Accident Investigation and Reconstruction
Qualification: Court Expert in Traffic Accident Investigation and Reconstruction (300 h) awarded by ASPEJURE with distinction. Plus years driving articulated lorries, which is where you really learn how a heavy vehicle moves and how long it takes to stop.
Speciality listed on the rolls of court experts of Aragón, Catalonia, Valencia and Madrid.

Frequently asked questions

Can an accident be reconstructed without seeing the vehicles?

Yes, though it takes more work. Where the vehicles are gone, the reconstruction uses the police report, the photographic record, the repair estimates — which describe the damage part by part — and the electronic data. The report always states what could not be verified.

What is an EDR and what does it store?

It is the event data recorder fitted to many modern vehicles. It stores a few seconds before and after the impact: speed, acceleration, brake application and seat belt use. It is objective evidence and it must be requested early, before the vehicle is repaired or scrapped.

The police report says otherwise. Is my report any use?

Yes. The police report is one piece of evidence, often produced quickly and without reconstruction tools. A technical report that redoes the calculations and explains the basis of every conclusion can correct it. The courts accept that daily.
